Marie & Seema GmbH - General Terms and Conditions

 

1. Scope of Application

These General Terms and Conditions (GTC) apply to all legal relationships between Marie & Seema GmbH, represented by the Managing Director and Creative Director, and the customer, who can be either a consumer within the meaning of Section 13 BGB or an entrepreneur within the meaning of Section 14 BGB, provided the customer is of legal age. The customer acknowledges these GTCs by clicking 'Buy now' and submitting the complete order form. Any terms and conditions of the customer are excluded unless expressly agreed by Marie & Seema GmbH.

 

2. Important Notes

2.1. Presentation Products displayed on www.marieandseema.com are represented as accurately as possible, but Marie & Seema GmbH cannot guarantee complete colour and image accuracy due to varying screen, graphic, and printer settings.

2.2. Single-Use Seal: All items are shipped with a Marie & Seema label. Please try on items without removing or damaging the label to facilitate returns.

  

3.Conclusion of Contract

 

3.1. Purchase Contract and Order Confirmation The product listings on www.marienadseema.com are not binding offers. By placing an order, the customer submits a binding offer. Order receipt is acknowledged on the website but does not constitute contract acceptance. A contract is concluded when Marie & Seema GmbH confirms the order, sends an invoice or ships the goods within 2-5 days.

3.2. Withdrawal If the supplier does not supply us with the goods ordered by you, we are entitled to withdraw from the contract unless we are at fault in this respect. In this case, we will inform you immediately that the product you ordered is not available. We will refund you immediately if the purchase price has already been paid. The reservation of self-delivery applies to consumers within the meaning of the customer. 13 BGB only in the event that a congruent covering transaction has been closed with the supplier, the supplier has left us abandonment in this respect, and www.marieandseema.com is not responsible for any incorrect or non-delivery.

3.3. Contract Language Contracts are concluded exclusively with Marie & Seema GmbH. The contractual language is German or English.

 

4. Right of Retention and Retention of Title

 

4.1. Right of Retention Customers may exercise the right of retention only for claims from the same contractual relationship.

4.2. Retention of Title Goods remains the property of Marie & Seema GmbH until full payment is received.

 

5. Customer Service

 

5.1. Returns & Exchanges Customers can return ready-to-ship items within 14 days of receipt. We don't exchange any items. However, if you want to buy a new item, please return the purchased item and place a new order of your choice.

5.2 Return of custom order is not possible as this piece is specially made for you. However, you can request possible alterations to the customised piece by writing to us at support@marieandseema.com.

5.3. Repayment Periods Refunds are processed within 10-14 days of return receipt, depending on the credit card issuer. Refunds are made to the buyer/cardholder.

5.4. Damaged or Incorrect Items Report damaged or incorrect items to support@marieandseema.com immediately for a replacement or refund.

6. Delivery and Shipping Costs

 

6.1. Deliveries are made from stock to the customer-specified address after debiting the customer's account.

6.2. Prices at www.marieandseema.com include VAT. Shipping is free for orders over €80; otherwise, shipping costs apply.

6.3. National Programmes: DHL does not deliver to PO Boxes or packing stations. Additional terms are at www.dhl.de.

6.4. Shipping Costs Orders are processed within 48 hours, extending to three working days during sales. Estimated delivery times are guidelines. Marie & Seema GmbH is not liable for delays due to extreme weather or unforeseeable circumstances.

 

7. Price and Payment

 

7.1. Prices include all taxes and price components.

7.2. Shipping Costs are shown separately during the order process and are additional unless free delivery is stated.

7.3. Payment Methods Available payment methods are detailed on the website.

7.4. Payment Due Payment claims are due immediately upon contract conclusion unless stated otherwise.

 

8. Warranty

 

8.1 The statutory rights of defects are held.

8.2 To ensure completeness, obvious defects, and transport damage upon delivery, inform us and the freight forwarding complaints as soon as possible. If you do not comply with this, your statutory warranty claims will not be affected.

 

9. Choice of Law

 

9.1. Applicable Law German law applies. For consumers, this applies only if it does not withdraw protection granted by the consumer's country of residence.

9.2. UN Sales Convention The UN Sales Convention does not apply.

11. Limitation Period: 

 

The limitation period for defect claims is two years from the date of delivery. Notify visible defects immediately.
